Affiliate Program Terms
Effective Date: January 2026
These terms govern your participation in the MoonFactory Affiliate Program ("Program"). By applying to or participating in the Program, you agree to these terms.
1. Program Overview
MoonFactory operates an affiliate program that pays commissions on qualified referrals who become paying clients of MoonFactory's Managed WordPress Services.
2. Commission Structure
2.1 Commission Rate: Affiliates earn 10% (ten percent) commission on the monthly recurring revenue of referred clients.
2.2 Recurring Commissions: Commissions are paid monthly for as long as the referred client remains an active, paying customer of MoonFactory's monthly service plans.
2.3 Qualifying Services: Commissions apply to:
- Core Plan ($195/month) → $19.50/month commission
- Growth Plan ($595/month) → $59.50/month commission
- Complete Plan ($625/month) → $62.50/month commission
2.4 Non-Qualifying Services: Commissions do NOT apply to:
- One-time project work (custom websites, design projects)
- Discounted or promotional rates
- Internal or employee referrals
3. Referral Tracking
3.1 Attribution: Referrals are tracked via unique affiliate links or codes provided upon approval. Referrals may also be manually attributed when the referred client mentions the affiliate during onboarding.
3.2 Cookie Duration: Affiliate tracking cookies persist for 90 days from the initial click.
3.3 First-Touch Attribution: The first affiliate to refer a client receives the commission. No split commissions.
4. Payment Terms
4.1 Payment Threshold: Commissions are paid when the affiliate's balance reaches $50 or more.
4.2 Payment Schedule: Commissions are paid monthly, within 15 days of the end of each calendar month.
4.3 Payment Methods: Payments are made via PayPal, direct deposit (ACH), or other methods at MoonFactory's discretion.
4.4 Collected Revenue Only: Commissions are calculated on revenue actually collected from the client. If a client's payment fails or is refunded, no commission is owed.
4.5 Taxes: Affiliates are responsible for all taxes on commissions earned. MoonFactory may require a W-9 (US) or W-8BEN (international) before issuing payments exceeding $600 annually.
5. Affiliate Obligations
5.1 Accurate Representation: Affiliates must accurately represent MoonFactory's services. No false claims, exaggerated promises, or misleading statements.
5.2 Brand Usage: Affiliates may use MoonFactory's name and logo in promotional materials, subject to brand guidelines. No modification of logos or creation of materials that imply official partnership beyond the affiliate relationship.
5.3 Prohibited Activities:
- Spam, unsolicited emails, or bulk messaging
- Paid advertising that bids on MoonFactory's brand terms
- Coupon/deal sites without prior approval
- Incentivized referrals (paying or rewarding users to sign up)
- Any illegal, deceptive, or unethical marketing practices
5.4 Disclosure: Affiliates must disclose their affiliate relationship in accordance with FTC guidelines and applicable laws. Example: "I may earn a commission if you sign up through my link."
6. Termination
6.1 Voluntary Termination: Either party may terminate the affiliate relationship at any time with written notice.
6.2 Termination for Cause: MoonFactory may immediately terminate affiliates who:
- Violate these terms
- Engage in fraudulent or unethical behavior
- Damage MoonFactory's reputation
- Remain inactive (no referrals) for 12 consecutive months
6.3 Effect of Termination: Upon termination:
- Affiliate links and tracking are deactivated
- Pending commissions on collected revenue will be paid
- Future commissions on existing referrals are forfeited
7. Commission Clawback
If a referred client cancels within 30 days of signup, or if a payment is charged back or refunded, MoonFactory reserves the right to deduct the associated commission from future payments.
8. Modifications
MoonFactory may modify these terms at any time. Affiliates will be notified of material changes via email. Continued participation after notification constitutes acceptance.
9. Limitation of Liability
MoonFactory's liability to affiliates is limited to unpaid commissions actually earned. MoonFactory is not liable for lost profits, indirect damages, or any claims arising from affiliate marketing activities.
10. Relationship
Affiliates are independent contractors, not employees, agents, or partners of MoonFactory. This agreement does not create a joint venture, partnership, or employment relationship.
11. Governing Law
This agreement is governed by the laws of the State of Florida.
